Welcome to BizScan360. These Terms of Service ("Terms") constitute a legally binding agreement between you and BizScan360 governing your use of our website and application (the "Service").

By accessing or using BizScan360, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.

User Accounts & Responsibilities

When you create an account with BizScan360, you agree to the following:

  • Age Requirement: You must be at least 18 years old to use our Service
  • Accurate Information: All information you provide must be accurate, complete, and current
  • Account Security: You are solely responsible for maintaining the confidentiality of your password and account credentials
  • Unauthorized Access: You must immediately notify us of any unauthorized use of your account or security breach
  • Account Termination: We reserve the right to suspend or terminate accounts that provide false information or violate these Terms

Subscriptions & Billing

Subscription Plans

BizScan360 operates on a subscription-based model. You will be billed in advance on a recurring basis (monthly or annually) based on your selected plan:

  • Starter: $10/month - For freelancers & micro-enterprises
  • Growth: $25/month - For startups & small businesses
  • Scale: $50/month - For consultants & growing agencies
  • Enterprise: $100/month - For large organizations

Payment & Renewal

  • Subscriptions automatically renew unless canceled before the renewal date
  • We accept payments via Polar payment gateway
  • You authorize us to charge your payment method for all fees incurred
  • Price changes will be communicated 30 days in advance and apply to subsequent billing periods

Cancellation & Refunds

  • You may cancel your subscription at any time through your Account Settings
  • Cancellations take effect at the end of the current billing period
  • No refunds are provided for partial subscription periods or unused features, except where required by law
  • Upon cancellation, you retain access to paid features until the end of your billing period

Intellectual Property Rights

Our Intellectual Property

The Service, including all content, features, functionality, software, algorithms, and user interface, is the exclusive property of BizScan360 and its licensors. This includes:

  • BizScan360 trademarks, logos, and brand assets
  • Proprietary health score calculation algorithms
  • AI-powered analysis and reporting systems
  • Dashboard designs and user interface elements

You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

Your Business Data

You retain full ownership of all financial and business data you upload to BizScan360. By using our Service, you grant us a limited, non-exclusive, revocable license to:

  • Process your data to calculate health scores and KPIs
  • Generate reports and AI-powered insights
  • Store your data securely on our servers
  • Display your data within your account dashboard

We never use your proprietary business data to train AI models or share it with third parties for marketing purposes.

Acceptable Use Policy

You agree not to use BizScan360 to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload malicious code, viruses, or any harmful software
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Resell, sublicense, or redistribute the Service to third parties
  • Interfere with or disrupt the integrity or performance of the Service

Violation of this policy may result in immediate account suspension or termination.

Limitation of Liability

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY

To the maximum extent permitted by law, BizScan360 and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, use, goodwill, or other intangible losses
  • Damages resulting from your access to or inability to access the Service
  • Unauthorized access, use, or alteration of your data or transmissions
  • Statements or conduct of any third party on the Service

Service Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding:

  • The accuracy or completeness of health score calculations
  • Uninterrupted or error-free operation
  • The suitability of the Service for your specific business needs
  • That defects will be corrected or that the Service is free from viruses

Termination

We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • At your request for account deletion

Upon termination, your right to use the Service will cease immediately, and we may delete your account data in accordance with our data retention policies.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of BizScan360 after the effective date constitutes acceptance of the revised Terms.
